He Would Not Close The Door

The Democratic Party has not accepted that decision and has never pretended to. Senator Ed Markey called the Court rogue and radical and said it must be expanded. Planned Parenthood and the national abortion-rights groups back the expansion bills for the stated purpose of restoring a federal right to abortion. The proposal is always the same number. Thirteen justices. Four new seats, filled by whoever holds the White House. Congressman Al Green filed it again on May 4 of this year. Congressman Ro Khanna carries his own version with eight Democrats signed on. Congressman Hank Johnson has run a thirteen-justice bill since 2021. Kamala Harris called for thirteen on July 31 in Nashville. Congressman Jim Clyburn, days before the vote below, said on national television that thirteen is a pretty good number, a baker's dozen would be good to have on the court. They are not hiding it. They want a different Court because they want different rulings.

THE VOTE

On September 2 the House was asked whether nine is the number, permanently.

House Joint Resolution 1 is one sentence. The Supreme Court of the United States shall be composed of nine justices, one chief justice and eight associate justices. With that sentence in the Constitution, no future Congress can add seats to win a case it lost.

Shomari Figures voted no.

Clerk of the House, roll call 293, September 2, 2026, 4:34 in the afternoon. The resolution got 212 to 206 and failed, because an amendment needs two thirds.

Republicans voted 211 to nothing for it. Democrats voted 1 to 205 against. One Democrat in the entire House broke ranks.

Figures was not the one.

THE ALABAMA COLUMN

Aderholt, yes. Moore, yes. Palmer, yes. Rogers, yes. Strong, yes.

Sewell, no. Figures, no.

Everyone Alabama sends to Washington was recorded on this. Nobody missed it. The delegation split five to two, and the two are the Democrats.

THIS IS NOT NEW FOR HIM

In January 2025 the House voted on the Born-Alive Abortion Survivors Protection Act, which requires a doctor to provide care to an infant who survives an abortion attempt.

Figures voted no. So did Sewell. Exactly one House Democrat voted yes.

That is the same pattern as September 2. On the question, he is where his national party is, and his national party is not where this district is.

WHAT THE DISTRICT BELIEVES

Alabama voters wrote protection of the unborn into their own constitution. This is not a close question here and it has not been for a long time.

The Second Congressional District now covers Dothan, Enterprise, Ozark, Eufaula, Troy, Andalusia, Greenville, Phenix City and the counties around them. These are church communities. They did not ask for a Congressman who votes with Ro Khanna and Jim Clyburn.

They have one.

THE ONE THING WE WILL GRANT HIM

Shomari Figures has not personally introduced a bill to add justices to the Supreme Court, and we are not going to say he has.

He did not have to. On September 2 he was handed the chance to close the door on it in writing, forever, and he declined. A man who wanted court-packing stopped would have voted yes. Two hundred eleven Republicans did. Don Davis of North Carolina did.

Figures went the other way with 205 Democrats, and he does not get to be surprised when Alabama notices.
